END USER LICENSE AGREEMENT (EULA)
IMPORTANT: PLEASE READ CAREFULLY
This End User License Agreement ("EULA") is a legal contract between you (referred to as "you" or "Licensee") and clearprintsinfo.com (Clear Prints Info). It outlines your rights and responsibilities when using Clear Prints Info. Please treat this like any legal agreement and review it thoroughly.
The software covered by this agreement consists of the application itself, any accompanying media, printed materials, online or electronic documentation, and any subsequent updates or internet-based services that relate to it. This software is being licensed—not sold—to you.
By installing, copying, or using the software, you are agreeing to be legally bound by the terms of this EULA. If you do not agree, please do not install or use it. If you haven't used or installed the software.

This agreement contains a class action waiver and binding arbitration, which apply only if you are a citizen or resident of the United States. You can choose to opt out of these by meeting certain requirements discussed further below.
1. What's Included ("Licensed Software")
The term "Licensed Software" includes:
- The software itself and all files/media accompanying it (for example, CDs and downloads)
- Third-party software accompanying the software
- User guides and related documents ("Documentation")
- Updates or upgrades we release later
2. Installing & Activating the Software
Unless you have a special multi-user license (a site license), you can install and use the software on one device per license. You can see how many licenses you bought on your receipt or order confirmation.
If you require additional licenses, you can purchase them from our user portal.
Some functionalities can only be activated online. We can ask you to input a serial number or create an account. Unless you activate within the specified period, the software won't function until activation is finished. Trial versions can be limited in time or functionalities.

3. Supported Devices
The software is meant for physical devices (laptops/desktops). We do not support virtual machines.
4. Internet Access Requirements
An internet connection is needed for certain features of the software. We cannot be held accountable for problems caused by a loss of internet connection.
5. Personal Data & Privacy
In using this software, you consent to our collection and use of certain information as described in our Privacy Policy. This includes information related to your account, device, and technical information for product improvement.
Some of this information may be stored or processed in nations outside your own, including the U.S.
6. Copies
You may make one backup copy of the software. You can't make copies of the documentation.
7. Transfer
You can't transfer, sell, rent, lease, sublicense, or assign this license or the software to anyone else except with our written consent.
8. How You Can Use the Software (and How You Can't)
You can use the software under a non-exclusive license. You can't:
- Modify, adapt, or translate it
- Create derivative works from it
- Reverse-engineer or decompile it
- Use older versions once you upgrade (you have to uninstall the old version)
- Use it in life-critical systems such as aircraft, nuclear devices, or life-support
- Remove or obliterate copyright or trademark notices
- Host it for third parties or provide it as part of any service bureau or shared arrangement
- Use it in any manner not specifically permitted under this agreement
9. Software & Content Updates
If this is an upgrade, you should have a valid license for the previous version. You may retain the older version for a while to facilitate transition, but you should discontinue using it later.
We may issue updates (e.g., virus definitions, drivers, databases) from time to time. These can be added, modified, or deleted at any time without warning.
10. Support
We do not have to provide technical support under this EULA. If technical support is required, you can buy support services on a separate basis.
11. Governing Law
This EULA is governed by the laws of Canada unless local consumer laws provide you with additional rights. The UN Convention on Contracts for the International Sale of Goods is not applicable.
12. Dispute Resolution
If you're outside the U.S. (e.g., EU, Canada): Disputes will be resolved by the British Columbia courts of Canada, unless your local consumer law dictates otherwise.
If you're in the U.S., we arbitrate disputes. This includes:
- You forego your right to a jury trial or class action
- A neutral third-party arbitrator will determine the result in place of a judge or court
To opt out of arbitration: Send a written notice within 30 days of signing this agreement to: clearprintsinfo.com, Legal Department, 1912 Capital Ave Ste 500, Cheyenne WY 82001.
Write your name in full, your address, and state that you want to opt out of arbitration.
Prior to arbitration, you will need to:
- Send a written notice detailing your dispute to the address stated above
- Wait 45 days for us to attempt to resolve it
If not resolved, arbitration shall be conducted by JAMS (www.jamsadr.com) in front of a sole arbitrator. No class arbitrations permitted. Arbitration shall be governed by the JAMS Comprehensive Rules.
Arbitration Location
You have the option of using Los Angeles, CA, or your federal judicial district. If you use the latter, we might move it to Los Angeles if we cover your extra fees.
Payment of Arbitration Fees and Costs
clearprintsinfo.com will pay all filing fees for arbitration and the arbitrator's expenses if you provide a written request before arbitration. You will have to bear any other costs you incur, like attorney fees or witness fees. If the arbitrator finds you are the prevailing party—and you have proceeded in good faith in accordance with the "Pre-Arbitration Claim Resolution" process—you could also be able to recover reasonable attorney's fees and related expenses, subject to applicable law.
Class Action Waiver
Unless otherwise stated, the arbitrator may not consolidate more than one user's claims or preside over any type of class or representative action (e.g., class actions, consolidated actions, or private attorney general actions), unless you and clearprintsinfo.com each agree after arbitration has commenced.
If you wish to opt out of arbitration (see "Exclusions from Arbitration"), this waiver will not be effective. Otherwise, you will not be permitted to act as a class representative or become involved in any class or group lawsuit regarding the licensed software.
Jury Trial Waiver
By signing this agreement, you and clearprintsinfo.com both agree to relinquish your rights to a jury or court trial. Without this provision, you would otherwise have had the right to a public hearing before a judge or jury and possibly join a class action. Those rights are waived. Although arbitration may still be able to offer remedies, it might not permit appeals or complete legal discovery like a traditional court.
Severability
If any section of this arbitration clause (other than the Class Action Waiver) is held unenforceable, the remainder continues in full force and effect. If the class action waiver itself is held unenforceable, the entire arbitration clause is void, and actions will be resolved in court rather.
Arbitrator Review
Any disagreement about the application or enforceability of this arbitration clause—or whether a dispute has to be arbitrated—will be resolved by the arbitrator.
Arbitration Terms Continue
All terms for resolving disputes in this agreement are binding, even if you discontinue using the software or close your account with us.
Limited Warranty – Physical Media
We promise the physical media (e.g., CD, DVD) carrying the software to be defect-free for 30 days from the date of shipment. In case you encounter a defect within this timeframe, you may return the media for replacement or refund—whichever we prefer.
No Warranty – Software and Services
The software and any associated Clear Prints Info or services are offered "as is" and "as available." We and our licensors do not make any express or implied guarantees as to:
- The availability, quality, or performance of the software
- The accuracy or reliability of data accessed using it
- Continued use without interruption or compatibility with your network or devices
- Freedom from bugs, viruses, or defects
We also don't undertake that the software is appropriate for any particular purpose, except where it is so required by law in your place of residence.
Limitation of Liability
To the fullest extent permitted by the law, clearprintsinfo.com and its third-party providers are exempt from:
- Any indirect, incidental, or special damages
- Lost profits, savings, or data
- Software failure or service disruption costs
- Claims by third parties
Our overall liability—regardless of the cause—will never exceed what you paid for the software, or €5 EUR, whichever is lower.
Beta Software Terms
If you acquired a beta (pre-release) version of the software, please be advised:
- It can have bugs or problems that lead to system crashes or loss of data.
- clearprintsinfo.com makes no guarantee it will be offered commercially.
- We are not responsible for any problems it creates, except to the extent the law provides otherwise.
- If you're outside the U.S., you promise to destroy or return all pre-release copies within 30 days of completing testing or upon release of the commercial version—whichever is first.
- You might be required to provide feedback or bug reports during testing.
Warranty and Liability Terms Survive Termination
Even after the end of this contract, exclusions of warranty and limitations of liability apply. This does not confer ongoing access or the right to use the software.
Export Restrictions
You might not export or use the software to infringe any export laws applicable, including U.S. export control regulations. Your right to use the software is subject to compliance with such laws.
Intellectual Property Ownership
All rights to the software—its code, structure, and organization—are owned by clearprintsinfo.com or our licensors. You are only allowed to use the software according to the terms of this agreement. No other rights are provided.
Reservation of Rights
We hold all rights not clearly given to you under this agreement. They are protected under copyright and intellectual property laws of Canada and other nations.
Entire Agreement
This EULA represents the complete and final understanding between you and clearprintsinfo.com for the software. It supersedes any prior discussions or understanding, and it binds both parties and successors.
Amendments to this Agreement
A written agreement executed by a representative of Clear Prints Info officer is the only one that can modify or supplement this EULA.
Severability of Terms
Except for the arbitration clause, if any part of this EULA is found to be unenforceable, the rest remains valid and enforceable.
No Waiver Unless in Writing
If we delay enforcing any part of this agreement, that doesn’t mean we’ve waived our rights. A waiver is only valid if we put it in writing.
Proof of Compliance
If asked, you need to show us documentation within 30 days that your use of the software is in accordance with this EULA.
Termination
If you violate this agreement and don't correct it within 30 days of being notified, we can terminate your license. You'll have to discontinue use of the software and return or verify the destruction of all copies.
